Definitions

  • “You”, “your”, “customer” and/or “buyer” mean: the individual or organization addressed on the invoice.
  • “Empowered PC”, “company”, “we”, “us” and/or “our” mean: Empowered PC

Non-Branded Warranty Coverage

All products that are not physically branded with Empowered PC or not modified by Empowered PC come as advertised, with only the standard original manufacturer warranty and 30 day online and phone support. If a computer system is hardware defective within the first 30 days of the delivery date, then Empowered PC will cover shipping costs within the Contiguous United States (lower 48 states).

For International Customers

Empowered PC will provide 30 days online and remote link support for international customers. International customers will be responsible for paying all freight charges incurred in shipping, importing/exporting, receiving replacement and repaired part(s) and product(s) and for arranging and paying for the shipment of any defective part(s) and product(s) back to Empowered PC. International customers are responsible for all custom duties, VAT and other associated taxes and charges. These charges are the recipient’s responsibility.

Branded Warranty Coverage

All products physically branded with Empowered PC or modified by Empowered PC come with a Limited Lifetime Service Policy (the “Lifetime Service Policy”) for all new laptops and desktops purchased from Empowered PC. This Lifetime Service Policy extends only to the original purchaser, original equipment, or subsequent upgrades purchased from and installed by Empowered PC and labor/service provided by Empowered PC.

All products physically branded with Empowered PC or modified by Empowered PC come with a 3-Year Limited Hardware Warranty (the “3-Year Warranty”) on all upgraded parts configured by us that will begin from the date of the original purchase. For all remaining stock OEM parts, the Non-Branded Warranty (see above) coverage applies instead of our 3-Year Warranty. Except in the case of Liquid cooling/water cooling components are covered for 1-year labor and parts and is not included in the 3-Year Warranty on any Empowered PC system. Special order parts are warrantied only for as long as their original underlying manufacturer warranty. AMD video cards are considered special order parts and are warrantied for 2-years labor and parts. Monitors are covered for 1-year labor and parts.

  1. If an issue should arise during the warranty period and is covered by the warranty, Empowered PC will be the first point of contact.
  2. During the first 30 days of your invoice date, if an issue should arise during the warranty period and is covered by the warranty, Empowered PC will cover the cost of shipping within the Contiguous United States (lower 48 states). Outside of Contiguous United States, you will be responsible for the cost of shipping the product to Empowered PC and we will ship the product back to you at your cost.
  3. After the first 30 days of your invoice date, if an issue should arise during the warranty period and is covered by the warranty, you will be responsible for the cost of shipping the product back to Empowered PC, and we will be responsible for the return shipping back to the Customer within the contiguous United States (lower 48 states) for up to one year after purchase. After one year from the original ship date, you will be responsible for any shipping charges to and from Empowered PC.
  4. Products sent in for authorization service/exchange must be shipped in original packaging and accompanied by copies of purchase receipts. Replacement packaging can be requested from Empowered PC customer support for a nominal fee.

Should your warranty be approved and verified, Company will issue a Return Merchandise Authorization (RMA) number, which is valid for ten (10) days. Any Product returned to Company that does not have a valid RMA number visible on the outside of the package will be refused. Product that is not defective will be returned to the customer after shipping charges have been collected.

To Request Warranty

Email [email protected] within the applicable warranty period. Provide your invoice number, product serial number, and reason for warranty request. Our support representatives will attempt to diagnose and resolve the problem over email, phone, and remote link. If we determine that the problem is with the product(s) or part(s) of the product(s), we will then either:

  1. Send you a replacement part(s) (while authorizing the cost(s) of the part(s) on a valid credit card and capturing said funds if replacement part(s) are not returned within 30 days).
  2. Return the product(s) to us for warranty service.

Should your warranty be approved and verified, Company will issue a Return Merchandise Authorization (RMA) number, which is valid for ten (10) days. Any Product returned to Company that does not have a valid RMA number visible on the outside of the package will be refused. Product that is not defective will be returned to the customer after shipping charges have been collected.

Shipping the Product

Ship the Product(s) back to Company in their original or equivalent packaging and accompanied by copies of purchase receipts. Replacement packaging can be requested from us for a nominal fee. Clearly mark the RMA number on the outside of the carton. All products sent in for warranty services must be complete with all components, cables, power supply just as you received it. Company is not responsible for any damage to the product that occurs while the product is in transit from you to Company, regardless of sufficient or negligent packaging. NOTE: You are responsible for your software and data. Company is not required to advise or remind you of appropriate backup and other procedures. Company is not responsible for any lost data or software in your Product.

Request for Replacement Part(s)

Empowered PC will issue you a Return Merchandise Authorization (RMA) Number before replacement part(s) are sent out. Once the original part(s) are returned, the replacement part(s) will be shipped to you. Replacement part(s) will be new or serviceably used, comparable or better in function and performance to the original part and warrantied for thirty (30) calendar days or the remainder of the warranty period, whichever is longer. You are responsible for the cost of shipping the original part back to Empowered PC. We will be responsible for shipping the replacement part to your address within the Contiguous United States (lower 48 states).

Advanced Component Exchange

In some cases, if approved, you can opt for an advanced component exchange of a replacement part(s). Empowered PC will ship the replacement part(s) before the receipt of the returned part(s). This minimizes the time that you are without a functioning computer. This process, however, requires that you guarantee the product we ship out with a credit card. We will process and hold on your credit card until we receive the returned product, which when received, we will cancel the held credit. However, if your return product is not received within 29 days, we will charge the value of the shipped product on the 30th day.

Return for Repair:

Company owns all parts removed from repaired products. Company uses new and reconditioned parts made by various manufacturers in performing warranty repairs and building replacement products. We will replace defective parts with the same or comparable parts at no cost. Any other part replacement that is different from the original configuration must be purchased at cost. lf Company repairs or replaces a product, the warranty term is not extended. Company will not reimburse Customer for any repairs or replacements performed by anyone other than Company or anyone not authorized by Company. Company will not replace, repair, or refund any purchase if the product serial numbers do not match our files, or if the product is not sold directly by Company

Products sent in for authorization service must be shipped in original packaging and accompanied by a copy of the purchase receipt. Replacement packaging can be requested from Empowered PC customer support for a nominal fee. Empowered PC is not responsible for any damage to the product that occurs while the product is in transit from you to Empowered PC, regardless of sufficient or negligent packaging.

For International Customers

The Lifetime Service Policy and the 3-Year warranty also applies to products physically branded with Empowered PC or modified by Empowered PC shipped to any location outside of the Contiguous United States (lower 48 states), provided that you are responsible for paying all freight charges incurred in shipping, importing/ exporting, receiving replacement parts and for arranging and paying for the shipment of any defective part(s) back to Empowered PC. All international customers are responsible for all customs duties, VAT, and other associated taxes and charges. These charges are the recipient’s responsibility.

This warranty does not cover

Warranties do not cover product damaged by external causes, including accident, abuse, misuse, improper installation, problems with electrical power, acts of third parties, Products that are altered or repaired by anyone not authorized by Company, usage not in accordance with instructions accompanying the Product(s), or failure to perform required preventive maintenance, including but not limited to backups, problems caused by use of software, parts and components not supplied by Company, weather conditions, lightning, fire, water, or any acts of nature or God; Company shall not be obligated to provide any warranty service or obligations unless customer has paid its invoices in full under this or any other Company invoice. All promotional items, shipping damage (other than the first original shipment) and all non-Company branded accessories are not covered in this warranty.

Empowered PC will not replace, repair, or refund any purchase if the item serial numbers do not match, or if the product is not sold directly by us. We will replace defective parts with the same or comparable parts at no cost. Any other part replacement that is different from the original configuration must be purchased at cost. Do not include any accessories with your computer system for warranty repairs. If you do include such accessories, Empowered PC will not be held responsible for any missing accessories such as software, adapters, etc. In the event no defect is found, we will charge a diagnosis fee, advise the Customer, and return the non-defective product only once the Customer has settled the aforementioned diagnosis fee and return shipping fees.

Protect Your Own Data and Software.

You are responsible for your software and data. Company is not responsible for loss of time, inconvenience, loss of data or software, inadvertent disclosure of data, loss of files, or any other direct, incidental, or consequential damage loss caused by a covered computer system failing to properly operate, or caused by any fault or negligence of the Company. Even though Company may attempt to backup and transfer certain data and attempts to avoid situations where your data or software is lost, such occurrences of data loss, for a variety of reasons, are common. You agree that prior to delivering a computer for service, you have independently backed up all software and data on the computer, and is prepared for, and expects that all data may be lost on the computer during or following any repair procedure, and you specifically agrees and understands that this document is intended to limit the liability of the Company for such data losses.

We desires to maintain a positive relationship with its customers and without waiving any of the limitations in the preceding paragraphs, Empowered PC may at its sole and exclusive discretion elect to return actual funds paid by Customer for goods or services provided by Empowered PC. Any such refund is in no way an admission of any liability, wrong-doing, or the basis for any cause of action against Empowered PC and is a simple expression of goodwill. In the event Customer is offered a refund of monies actually paid, each and every aspect of this Waiver and Limitation of Liability shall remain in full force and effect. Customer waives all rights, claims, causes of action, and other damages in excess of actual funds paid and then returned by Empowered PC.

Engraved Product Policy

Products that are engraved cannot be returned. The 30 day return period does not apply to engraved products. Company’s limited warranty does not cover replacement of engraving. In the event your engraved product receives service under Company’s limited warranty or any extended service plan offered by a third party, use of necessary replacement parts may eliminate the engraving on the product.

Limited Hardware Warranty Coverage

Thank you for purchasing from Empowered PC. This Limited Hardware Warranty is solely for computer hardware sold separately and extends only to the original purchaser and is non-transferable.

Your hardware is protected with a limited Hardware Warranty valid from the date of purchase for the greater of the manufacturer’s remaining warranty or 1-year for hardware sold new. In order to claim eligibility, Empowered PC should be the first point of contact for any warranty support so we may guide you in the proper channel for warranty services. If we authorize you to return your product, you will receive a Return Merchandise Authorization (RMA) number.

ALL RETURNS MUST HAVE A RETURN MERCHANDISE AUTHORIZATION (RMA) NUMBER, OTHERWISE THEY WILL BE REFUSED AND RETURNED TD THE SENDER.

During the warranty period, Empowered PC, at our sole discretion, will repair or replace the hardware if the hardware proves to be defective in material or workmanship, under normal use. Defective hardware will be repaired or replaced without charge, excluding shipping and handling after the first 30 days from purchase date, and can be replaced with either a new, used, refurbished, recertified, or comparable hardware that is a performance equivalent to the hardware returned. Performance equivalent exchanges are at the sole discretion of Empowered PC. By sending hardware for replacement, you agree to transfer ownership of the original hardware to Empowered PC.

Data recovery or transfer is not covered under this Limited Hardware Warranty and is not part of the repair or replacement process. You agree that prior to returning hardware for warranty service, you have independently backed up all data, and is prepared for, and expects that all data may be lost on the hardware during or following any repair procedure.

This Limited Hardware Warranty does not cover any problems or damage, resulting from, but not limited to, any of the following: wear and tear associated with normal use; damage caused to the product(s) by you or any non-authorized third-party; damage caused by acts of nature, abnormal mechanical or environmental condition, modification, abuse, accident, disassembly, misapplication, neglect, or abnormal use conditions; products with modification to the serial number or manufacturer identification label(s) or sticker(s), whether removed, falsified, damaged, altered, or made illegible; damage caused by improper assembly, handling, installation, or operation; including any use not in accordance with any supplied product instructions; damage caused by an external electrical fault or by connection to an improper voltage supply; removal or reassembly of heat spreader; missing, damaged, detached, eroded, or bent contact pins, chips, parts, casing, connectors, or heat spreader; shipping damages (other than the first original shipment); any other cause which does not relate to a product defect in materials or workmanship.

Empowered PC is not liable for and does not cover under warranty: recovery of data; installations of hardware; inspection or testing costs; installation and removal fees; and general, special, incidental, or consequential damages which include, but not limited to, loss of data, revenue, or profit (whether direct or indirect).

Disclaimer

Empowered PC’s sole obligation and liability under this warranty is limited to the repair or replacement of defective hardware at our discretion. Empowered PC shall not, in any event, be liable to the purchaser for any incidental or consequential damage, (including, but not limited to, damages resulting from interruption of service and loss of business), or liability in tort relating to this hardware or resulting from its use or possession.

Limitation of Liability

BUYER’S SOLE AND EXCLUSIVE REMEDY AND COMPANY’S SOLE LIABILITY FOR LOSS OR DAMAGE ARISING FROM PURCHASE OR USE OF THE PRODUCT SHALL BE LIMITED TO REPAIR OR REPLACEMENT OF THE PRODUCT AT COMPANY’S SOLE DISCRETION.

IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY LOSS OF USE, REVENUES, OR ANTICIPATORY PROFIT, OR FOR ANY DIRECT, INDIRECT OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR CONNECTED WITH THE SALE, USE, OPERATION, OR INABILITY TO USE OF PRODUCTS PURCHASED FROM COMPANY TO THE EXTENT PERMITTED BY LAW, COMPANY MAKES NO OTHER REPRESENTATIONS OR WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ALL SUCH WARRANTIES ARE EXPRESSLY DISCLAIMED TO THE EXTENT PERMITTED BY LAW (TO THE EXTENT THEY MAY NOT BE DISCLAIMED, COMPANY LIMITS THE DURATION OF SUCH IMPLIED WARRANTIES TO THE DURATION OF THIS LIMITED WARRANTY). IN NO EVENT SHALL COMPANY’S LIABILITY EXCEED THE AMOUNT OF THE PARTICULAR DEFECTIVE PRODUCT PAID BY THE PURCHASER. THIS LIMITATION OF LIABILITY SHALL BE APPLICABLE TO ANY CLAIM PRESENTED, WHETHER THE LEGAL THEORY FORMING THE BASIS OF SUCH CLAIM INVOLVES CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, REGULATION, CONSUMER PROTECTION LAWS OR OTHERWISE.

EXCEPT AS EXPRESSLY STATED HEREIN, COMPUTER UPGRADE KING MAKES NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESSED, VERBAL OR IMPLIED, OF ANY KIND WITH RESPECT TO PRODUCTS SOLD BY COMPUTER UPGRADE KING.

Governing Law

This Agreement shall be governed and construed in accordance with the laws of the Commonwealth of Virginia, without regard to any conflict of laws principles. Buyer agrees that competent courts in Chesterfield County, Virginia or the United States District court for the Eastern District of Virginia, Richmond Division shall have the exclusive jurisdiction over any legal action with respect to this contract. In the event of any dispute related to this contract, the prevailing party shall be entitled to reasonable attorneys’ fee and costs.
